Terms of Service

Terms of Service for Fundamentalist Artschool

By purchasing a course, registering for a workshop, or using the Fundamentalist website (the "Services"), you ("Student," "You," or "User") agree to be bound by these Terms of Service ("Terms"). Please read them carefully. 
 

1. Registration and Eligibility

  • Age Restriction: You must be at least 16 years old to register. If you are under 16, a parent or guardian must register on your behalf.

  • Accuracy: You agree to provide accurate, current, and complete information during the registration process. 

2. Fees, Payments, and Refunds

  • Payment: All online classes must be paid in full at the time of booking to secure your spot.

  • Refund Policy: All fees are non-refundable. Fundamentalist cannot accept responsibility for changes to your personal circumstances that prevent attendance.

  • Missed Classes: No refunds or credits are provided for missed sessions. In case of illness, you may request to transfer to a "catch-up" session if available, within a specified timeframe (e.g., 3 weeks), at the discretion of the instructor.

  • Cancellation by Us: We reserve the right to cancel a class due to unforeseen circumstances, such as illness or technical issues. In such cases, a full refund or a make-up class will be provided. 

3. Intellectual Property Rights

  • Ownership: Fundamentalist retains all rights, titles, and interests in the artwork, course curriculum, videos, handouts, and materials provided (the "Content").

  • Usage License: Upon payment, you are granted a limited, non-exclusive, non-transferable license to access, view, and use the content for personal, non-commercial purposes.

  • Prohibitions: You are strictly prohibited from copying, reproducing, selling, sharing, or distributing any of our content to third parties. 

4. User-Generated Content and Media Release

  • Artwork and Images: You retain ownership of the artwork you create during the class.

  • Marketing Consent: By enrolling, you consent to Fundamentalist taking screenshots of you or photos of your artwork during online sessions for promotional purposes (social media, website, brochures).

  • Opt-Out: If you do not wish for your image or artwork to be used, you must inform us in writing at the beginning of the course. 

5. Code of Conduct

  • Respectful Behavior: Students are expected to behave respectfully towards instructors and peers.

  • Termination: Any disruptive, inappropriate, or unsafe behavior will result in immediate removal from the class without a refund. 

6. Technical Requirements and Liability

  • Your Responsibility: You are responsible for ensuring you have a stable internet connection and the necessary software (e.g., Discord or Zoom) to participate.

  • Limitation of Liability: Fundamentalist is not liable for any injuries, damages, or losses sustained during the use of our services, including technical failures, except as required by law. 

7. Changes to Terms

We reserve the right to change these conditions from time to time. Your continued use of the website and services following such changes shall be deemed your acceptance of the new terms.
